Please read these Terms of Use carefully before using 8Track.ca (the "Site"). By using the Site, you signify your agreement with these Terms of Use. If you do not agree with any of these Terms of Use, do not use the Site. 8Track reserves the right to modify, alter or update these Terms of Use at any time and you agree to be bound by such modifications, alterations and updates.

Passwords

Certain areas of the Site are password-protected. If you have been issued a username and password by 8Track, then you are solely responsible for the password and maintaining its security. You will keep the password confidential and will not disclose it to any third parties (unless authorized by 8Track), and you will not use the password for any unauthorized purposes. You agree to immediately notify 8Track of any unauthorized use of your account or breach of security, including loss, theft, or unauthorized disclosure of the password or login information, as follows:

If you are under 19 years of age, then you confirm that you have discussed the Site with your parents or legal guardians, and you confirm that you have your parents' or legal guardians' permission to receive a username and password, and to access and use the password-protected areas of the Site.

8Track reserves the right, in its sole discretion, to revoke access to the password-protected areas of the Site if 8Track believes that these Terms of Use have been violated or that you or any user are otherwise using the Site inappropriately.

Intellectual Property

All content and material on this Site is protected under applicable copyright, trademark and other proprietary or intellectual property rights. The copying, redistribution, use or publication by you of any such content or any part of the Site, except as allowed below, is strictly prohibited. You do not acquire ownership rights to any content or materials obtained through the Site.

The viewing or downloading of any form or document, which has been expressly made available by 8Track for download and use, allows you a limited, non-exclusive right to use the form or document solely for your own personal use and not for any other use.

Submissions

In using the Site, you may have the opportunity to post or upload communications, materials or other information ("Information") to the Site. You agree as follows with respect to all such Information:

You are solely responsible for the content of any Information you post to the Site. 8Track reserves the right to take any action with respect to such Information that it deems necessary or appropriate, in its sole discretion, if 8Track believes any Information is inappropriate for the Site.
You own and manage your customer data and it is your sole responsibility to maintain. You also acknowledge that any Information that you post to the Site will not be viewed by other Site users.
You agree and represent that any Information posted or uploaded to the Site does not: infringe the copyright, trademark, patent or other proprietary rights of any third party; violate any law; contain obscene, abusive or threatening content or anti-8Track references; or otherwise contain content inappropriate for the Site having regard to the nature and purpose of the Site.
All Information posted or uploaded to the Site becomes the property of 8Track, and 8Track shall have an exclusive, unrestricted, irrevocable right and license to use the Information and all intellectual property rights associated with the Information, including copyright and trademark rights, for any purpose whatsoever, including advertising and promotional purposes.

All information in any format posted to the Site is subject to the provisions of the BC Freedom of Information and Protection of Privacy Act.

You may not post personal information to the Site about identifiable third parties without their explicit permission.
Personal information posted to the Site is considered confidential. You should not copy or disclose this information to third parties that do not have legitimate access to the Site.

These Terms of Use shall be governed by, construed and enforced in accordance with the laws of the Province of British Columbia.
